This privacy policy explains how Homebird Interiors Ltd collects and uses personal information when you visit our website, shop with us online or in one of our stores, arrange a delivery, contact us, enter a competition, receive marketing or apply for a job. It also explains who we share information with, how long we keep it and the rights available to you.

We have not appointed a formal Data Protection Officer. Privacy enquiries are handled by our management team using the contact details above.

The information we collect

The information we collect depends on how you interact with us. We try to collect only what we need for the relevant purpose.

Website visits and online activity

When you visit our website, Shopify and the technologies used on our site may collect information about your device and activity. This can include your IP address, browser and device type, time zone, cookie identifiers, approximate location, pages and products viewed, searches, referring pages, and the way you interact with our site and marketing.

We use this information to operate and secure the website, remember choices, measure how the site is used, understand the effectiveness of advertising and, where you have consented, personalise marketing. Further information is set out in the Cookies and online advertising section below.

Online orders and customer accounts

When you place an online order or create an optional Shopify customer account, we may collect your name, email address, telephone number, billing and delivery addresses, account details, order history, delivery instructions and correspondence about the order. Shopify Payments processes online payments. We do not receive or retain your complete payment-card details.

Store and telephone purchases

Our point-of-sale system normally records the products sold and transaction details rather than a customer profile. Card payments are processed by our payment provider, and we do not retain complete card details. If a purchase requires delivery or follow-up, we collect the contact and delivery information needed to fulfil the order.

Deliveries

For deliveries carried out by our own team, we place the name, delivery address, telephone number and relevant delivery instructions on a secure delivery spreadsheet. Access is restricted to people who need the information, and the entry is deleted once the delivery has been completed. Where an external carrier is used, we provide it with the information needed to complete the delivery.

Enquiries and customer service

If you contact us in person, by telephone, by email, through social media or through the website, we may collect your contact details and the content of your enquiry, together with any information needed to answer it, resolve a complaint or provide after-sales support.

Marketing and newsletter subscriptions

If you sign up to receive marketing, we collect your name where provided, your email address, the source and time of the sign-up, marketing preferences, and information about your interaction with our emails and website. We may use purchase history, products viewed and engagement with previous messages to create audience segments and make our emails more relevant.

Sign-ups may take place through our website, an in-store landing page or a paper form used for a promotion. Paper forms are kept securely while being processed and are securely destroyed after the information has been entered and checked. Klaviyo provides our email-marketing platform. We do not currently send SMS marketing.

Competitions and promotions

When you enter a competition or promotion, we may collect your name, email address, store or entry location, entry date and any information needed to administer the competition. If you also agree to receive marketing, the relevant information is added to our marketing records. If you do not agree to marketing, we delete the entry information after the competition and any related prize administration are complete, unless we must retain a limited record for legal or accounting reasons. We will ask a winner before publishing their name or photograph.

CCTV

Our premises may use CCTV where indicated by appropriate signage. CCTV is used to help protect customers, staff, property and stock, and to investigate accidents, suspected crime or other incidents. Images may include customers, visitors, staff and vehicle registration numbers.

Job applicants

If you apply for a role with us, directly or through a recruitment platform such as Indeed, we may collect your name, contact details, employment history, qualifications, CV, interview notes, references and other information you choose to provide. We use this information to assess your application, communicate with you and manage the recruitment process. Information about health, disability or other sensitive matters is used only where necessary and permitted by law, for example to make reasonable adjustments.

Information we receive from other sources

Most personal information is collected directly from you. We may also receive information from Shopify, payment providers, delivery partners, advertising and analytics providers, social-media platforms, recruitment platforms such as Indeed, or another person acting on your behalf. We do not buy marketing lists or obtain customer details from data brokers.

How and why we use personal information

UK data protection law requires us to have a lawful basis for each use of personal information. The bases that normally apply to our activities are set out below. More than one basis may apply where we use the same information for different purposes.

Marketing choices

You can unsubscribe from marketing at any time by using the unsubscribe link in any marketing email or by contacting us at help@homebirdfurniture.co.uk. We will act on your request promptly.

When someone unsubscribes or objects to marketing, we may retain the email address on a suppression list. This is not used to send marketing; it is retained so that we can respect the request and avoid adding the address back to an active mailing list by mistake.

Cookies and online advertising

Our website uses cookies, pixels and similar technologies. Some are necessary for the site, basket, checkout, security and customer-account features to work. Others help us understand website use, measure advertising, remember preferences and show or send marketing that may be relevant.

·       Klaviyo tracking, which helps us operate sign-up forms, understand email and website engagement, and send messages such as abandoned-cart or browse-reminder emails where permitted

Where the law requires consent, non-essential cookies and similar technologies should not be used until you have made a choice. You can review or change your choices through the cookie settings available on our website and can also control cookies through your browser. Blocking necessary cookies may prevent parts of the website or checkout from working correctly.

The technologies used on the site can change as services are updated. The cookie settings tool on the website should provide the current categories and available controls.

Automated processing and profiling

We use limited profiling to group customers and subscribers according to factors such as products viewed, purchase history, store or sign-up location, and engagement with previous emails. This helps us decide which products or messages may be relevant. You can object to direct marketing at any time.

Shopify, Shopify Payments and other service providers may use automated systems to detect fraud, secure transactions or assess payment risk. Homebird does not make decisions based solely on automated processing that produce legal or similarly significant effects for customers.

Who we share information with

We do not sell personal information or share customer details with other businesses for their own unrelated marketing. We disclose information only where it is needed for a service, permitted by law or required to protect our rights. Recipients may include:

·       Shopify and Shopify Payments, for hosting, accounts, orders, checkout and payment processing

·       Klaviyo, for email marketing, marketing preferences, sign-up forms and related website tracking

·       Google and Meta, for analytics and advertising where the required consent has been obtained

·       website, hosting, IT, security and Shopify-app providers that support our systems

·       delivery and courier partners where they need contact, address and delivery information to fulfil an order

·       Indeed and other recruitment providers where you apply through their services

·       professional advisers such as accountants, lawyers, insurers and auditors where necessary

·       law-enforcement bodies, courts, regulators, tax authorities or other public bodies where disclosure is required or permitted by law

·       a buyer, seller or adviser involved in a proposed sale, restructuring or transfer of all or part of our business, subject to appropriate confidentiality arrangements

Service providers acting on our instructions may use personal information only to provide the agreed service and must protect it appropriately. Some providers also act as independent controllers for parts of their service, particularly payment, advertising, social-media and recruitment platforms. Their own privacy notices explain those uses.

International transfers

Some of our providers operate internationally, so personal information may be processed outside the United Kingdom. This can include processing in Canada, the United States and other countries in which Shopify, Klaviyo, Google, Meta or their approved providers operate.

Where information is transferred to a country that has not been recognised as providing an adequate level of protection, we expect the relevant provider to use an approved safeguard, such as the UK International Data Transfer Agreement, the UK Addendum to the European Commission's standard contractual clauses, or another lawful transfer mechanism. You may contact us if you would like more information about the safeguards relevant to your information.

How long we keep information

We keep personal information only for as long as it is reasonably needed for the purpose for which it was collected. We consider the nature of the information, warranties and customer-service needs, possible disputes or claims, and any accounting, tax or other legal requirements. Our usual approach is as follows:

Normally retained for up to 30 days, unless footage is needed for an incident, investigation, insurance matter or legal claim

Unsuccessful job applications

Normally retained for up to 6 months after the recruitment process. With the applicant's agreement, relevant details may be kept for up to 12 months for future vacancies

Cookie and analytics information

Retained according to the duration of the relevant cookie and the settings of the service concerned

We may keep information for longer where the law requires it, where a complaint or legal claim is in progress, or where an authority or insurer asks us to preserve relevant records. When information is no longer required, it is deleted, anonymised or securely destroyed.

How we protect information

We use reasonable technical and organisational measures intended to protect personal information against accidental loss, unauthorised access, alteration or disclosure. Measures include restricting access to people who need the information, using reputable service providers, securing accounts and systems, and deleting information when it is no longer needed. No online service or storage system can be guaranteed to be completely secure.

Your data protection rights

Depending on the circumstances, you may have the right to:

·       ask for confirmation that we use your personal information and obtain a copy of it

·       ask us to correct information that is inaccurate or complete information that is incomplete

·       ask us to erase personal information in certain circumstances

·       ask us to restrict the way we use information in certain circumstances

·       object to processing based on legitimate interests and object at any time to direct marketing

·       receive certain information in a structured, commonly used and machine-readable format and ask for it to be transferred where the right to data portability applies

·       withdraw consent at any time, without affecting processing carried out before withdrawal

·       ask for human intervention where a legally significant decision has been made solely by automated means

These rights are not absolute and do not all apply in every situation. We may need to ask for information to confirm your identity before acting on a request. We normally respond within one month, although the law allows additional time for a complex request. We do not normally charge a fee.

Children

Our website and services are intended for adults. We do not knowingly collect children's personal information for marketing. If you believe a child has provided information inappropriately, please contact us so that we can investigate and delete it where appropriate.

Our website may link to services operated by other organisations, including social-media platforms. Those organisations are responsible for their own privacy practices, so please review their privacy information before providing personal details.
